AT&T asks judge to toss Sprint lawsuit

AT&T has asked a federal judge to toss a lawsuit brought against it by Sprint, Reuters reported on Friday. Sprint filed its lawsuit on September 6th and said it was fighting “on behalf of consumers and competition.” Sprint also argued that AT&T’s planned acquisition of T-Mobile USA is “illegal.” As one might expect, AT&T does not see eye-to-eye with Sprint on those allegations. “Sprint cannot wrap itself in the cloak of wireless service consumers’ interest because Sprint is not a consumer but instead a competitor in the sale of wireless services,” AT&T said in its court filing, noting that Sprint’s argument has a “lack of standing.” AT&T also responded to Sprint’s lawsuit earlier this month when it said: “This simply demonstrates what we’ve said all along – Sprint is more interested in protecting itself than it is in promoting competition that benefits consumers.” Sprint is not alone, however. The United States government filed a suit against AT&T in an attempt to block the merger in late August.

AT&T: Sprint has been lying for months about motives for opposing T-Mobile merger

The already-bloody battle over AT&T’s proposed $39 billion acquisition of T-Mobile USA recently became an all-out war. Sprint has been vocal with its opposition of the merger since day one, and comments from company CEO Dan Hesse on Wednesday may have shed some light on a previously undisclosed reason for Sprint’s stance. “I don’t believe that what the DOJ said in any way, not even a little bit, should be viewed as we want to keep four,” Hesse said at an investor conference. “My view is the Justice Department would look at other consolidation very differently.” Hesse went on to suggest that a “very strong argument” could be made that regulators would approve a merger between Sprint and T-Mobile. In light of these comments, AT&T has gone on record in stating that Sprint has been lying about its motives for the past several months. Read on for more.

Sprint may cap mobile hotspot data on smartphones at 5GB beginning October 2nd

Sprint will reportedly introduce a 5GB cap on mobile hotspot data for smartphone users beginning October 2nd. A purported leaked document obtained by SprintFeed states that Sprint’s $29.99 Wi-Fi tethering add-on for smartphones will no longer be unlimited beginning early next month. Additional data above the 5GB cap will be billed at $0.05 per megabyte according to the document. The new policy would not impact standard smartphone data, nor would it affect the mobile hotspot function on tablets. This is a slippery slope, however, and it could indicate that Sprint’s unlimited data plans are eating too much the carrier’s margins to be sustainable. Sprint has told BGR on numerous occasions that it will continue to offer unlimited data plans for as long as it can, and the carrier is expected to launch Apple’s iPhone 5 next month with unlimited data. Sprint did not immediately respond to a request for comment.

AT&T offers to sell assets to Sprint in bid to win T-Mobile deal approval

AT&T has approached several U.S. wireless carriers offering to sell assets, spectrum and wireless subscribers in an effort to win the government’s blessing for its planned acquisition of T-Mobile USA, Bloomberg reported on Monday. MetroPCS, Leap Wireless, CenturyLink, Dish Network and Sprint were among the the companies approached in the private talks. AT&T’s move is no doubt a response to recent lawsuits that were filed by the Department of Justice and Sprint. The Department of Justice filed a lawsuit on August 31st in an attempt to block the merger, which it said would “remove a significant competitive force from the market.” Seven U.S. states also joined the DOJ’s suit last week. Sprint sued on September 6th and said the merger would “stifle innovation” in the U.S. wireless market. AT&T’s discussions to sell assets may not be enough to sway the Department of Justice in AT&T’s favor and the talks are still preliminary, Bloomberg said.

Sprint in talks to buy Clearwire for 4G LTE roll-out

Sprint is in talks to purchase Clearwire outright, Bloomberg reported on Friday. The carrier has been speaking to a number of firms including Comcast about the possible acquisition, which would help Sprint build out a 4G LTE network capable of going head-to-head with competing networks from Verizon Wireless and AT&T. Cox Communications has also been involved in the discussions, Bloomberg said. Sprint could take one of two paths: it could invest more in Clearwire, although it already owns a controlling 54% stake in the company, or it could acquire it fully. Clearwire has said that it needs roughly $600 million to roll out LTE alongside its current 4G WiMAX network. In late July, however, Sprint inked a deal with network wholesaler LightSquared, in which LightSquared agreed to pay Sprint $9 billion and give the firm several billion more in service credits over 15 years for the right to use Sprint’s infrastructure to build out its own 4G LTE network. Bloomberg said Sprint’s talks with Clearwire are still in early stages and a deal is not imminent.

Sprint to offer cloud services in Q4

Sprint’s head of business markets Paget Alves recently confirmed to CNET that the carrier will launch cloud-based services during the fourth quarter of this year. The offering will be available to small and medium sized business customers. Sprint will provide security, software and Internet hosting, and it will also offer an “infrastructure as a service” option, Alves told CNET. “The telcos are in a unique position because our business is centered around the cloud,” Alves said. “There’s quite a bit of demand. It’s the number one topic of conversation with chief information officers.” Other carriers are also working on cloud-based services; in April, Verizon Wireless acquired cloud and managed IT infrastructure leader Terremark Worldwide for $1.4 billion.

Update: We’ve gotten numerous reports in the comments on this post, in our forums and at Sprint’s forums saying this update’s bricking phones. Sprint acknowledged earlier in the day that there might be issues, but we’ve yet to receive a follow-up. For now, we’d hold off on installing this update.

Photo tour: Sprint Technology Integration Center

And now comes the fun stuff. BGR on Wednesday toured a number of labs here at Sprint’s Midwest headquarters in Overland Park, Kansas. Some we’re able to talk about and some we can’t unfortunately, but among the ones we can show you is the Sprint Technology Integration Center located down the road from Sprint’s main campus in Lenexa, Kansas. This facility houses 15,000 square feet of laboratory space and the teams that dwell within are focused on network performance testing; devices that enter this lab have already gone through third-party testing and will now undergo validation testing. Sprint has specific requirements outside of compliance standards in order to ensure that devices on its networks meet its high standards, and this lab is home to the majority of equipment used to perform those tests. Among the jewels to be found within the gallery linked below is the ever-popular RF chamber. Foam spikes… gel-filled head positioned oh so carefully… this is one of the staples of cellular labs that we all look forward to seeing. The RF chamber is designed to create very specific test environments for devices in order to provide a level of control that would otherwise be impossible to achieve. There are also a few shots of demos we were given of a couple different test setups, including navigation testing and streaming video testing. The full gallery can be seen via the link below.
